Burr Oaks Press Release July 17, 2009

Attorneys for the Plaintiffs, in the first class action lawsuit filed on behalf of the bereaved families, were successful in securing a receiver for the Cemetery.
 
The Plaintiffs saw that nothing was being done to manage the Cemetery so a request, along with a lawsuit, was put in for a receiver (someone to run the cemetery).   Neither Sheriff Dart nor the AG’s office had made such a request.  In fact, Sheriff Dart waited four days after Plaintiffs had made their request to the judge, before he considered joining in Plaintiffs’ lawsuit to get a receiver.
 
“There was so much suffering, we had to do something” says Plaintiffs’ lawyer, Deidre Baumann.  “No one was running the ship and it was going down in flames” says Blake Horwitz, also attorney for the Plaintiffs.
 
As a result of the obvious mismanagement of the Cemetery, along with the pain that people were suffering, our law firm made an immediate request to Judge Palmer on, July 10, 2009 to have a receiver appointed.  At that time, Judge Palmer set a hearing for Tuesday, July 12, 2009, 2:00PM.  On Tuesday, Dart’s office, following Plaintiffs’ lead, filed its first request with the court, later followed by the request from the office of the Attorney General.  The Judge ordered on July 12 that a receiver be appointed and then chose the receiver the following day.  The final order was entered July 16, 2008 for appointment of the receiver. 
 
The receiver has been in direct contact with our office.  We are starting to get answers to questions.  Though it is still too soon to know about the grave sites, we have learned about the complicated corporate structure of Bur Oaks.  The receiver is also attempting to find the various assets of Burr Oaks, to make sure that money is not squandered.
